About
Zach Anderson, Owner
Estate planning used to be about planning for death, dividing your assets (usually to your spouse or children, equally), and filling out some basic forms. But we’re all living longer than we ever have. Long-term care costs have never been higher. We have more blended families now than ever before. And there are more opportunities to plan for children and adults with special needs than ever before. Traditional estate planning doesn’t stack up anymore.
After spending too much time complaining about it, Zach decided to do better for clients, and he founded Anderson Estate Planning in 2023.
Problems with Probate
Completely avoiding probate court is a part of many of our client’s estate plans. You may be wondering, what is so bad about it?

SIGNS YOU MAY NEED A TRUST
Anyone can create a trust. A trust is simply an agreement between a trust maker and a trustee to hold and administer property for the benefit of one or more beneficiaries.
There are many different kinds of trusts, and trusts can be fully customized to reach all the goals of you and your family.
Trusts can achieve the following:
- Plan for and protect a blended family
- Plan for long-term care
- Proactively plan for tax minimization
- Protect your spouse, children, or anyone else from creditors, predators, and spenders
- Have your estate be completely private
- Have your estate be administered as quickly as possible
- Completely avoid probate court
- Plan for and protect a blended family

F.A.Q.
WAS IT DRAFTED BEFORE 2014?
In 2014, Alabama passed the Uniform Power of Attorney Act, which drastically changed the law governing POAS in Alabama.
IS IT DURABLE?
A durable POA remains effective after you can no longer manage your affairs.
DOES IT MESH WITH YOUR OTHER ESTATE PLANNING DOCUMENTS?
For example, do your POA gents have signatory authority over your bank accounts? Do people other than your agents have this authority? Are your POA agents trustees over your trust(s) in similar situations?
DOES THE POA GIVE YOUR AGENTS THESE SPECIFIC POWERS?
- Create, amend, or revoke trusts
- Change a beneficiary designation
- Apply for and plan around government benefits, such as VA or Medicaid benefits
- Transfer assets over the annual exclusion amount
